ORDER

The petitioner is an accused in C.C. No. 305 of 2026 on the file of the 1st Additional Special Court for Exclusive Trial Cases under NDPS Act. The petitioner was arrested and remanded to judicial custody on 15.11.2025 for the alleged offence under Sections 8(c) r/w 20(b)(ii)(c) of NDPS Act,1985 in Crime No.176 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 15.11.2025 at about 12.15 hours, on receipt of secret information, the respondent along with their team went to Thiruverkadu, Koladi and found the accused to be in illegal possession of 25 kgs of ganja. Hence, the case.

3. The learned counsel for the petitioner submits that the seized contraband from the petitioner is only 11 kgs which is an intermediate quantity and the petitioner is in judicial custody from 15.11.2025. Hence, prays to grant bail to the petitioner.

4. The learned Counsel for Government of Tamil Nadu (Crl Side) submitted that the total quantity involved in this case is 23 kgs which is a commercial quantity. He also submitted that this is the third bail petition before this Court and the earlier bail petitions in Crl.O.P.No.35908 of 2025 and Crl.O.P.No.3499 of 2026 was dismissed on 05.01.2026 in on 13.03.2026 respectively. Hence, he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts of the case and he quantity involved in this case is commercial in nature and the petitioner failed to satisfy twin conditions under section 37 of NDPS Act, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed. 11-06-2026 Index: Yes/No Speaking/Non-speaking order SMN To.
