ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 399 of IPC in Cr.No.1573 of 2020 seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused persons were alleged to have been preparing to commit dacoity by using chilli powder. Hence, the law enforcing agency registered a case against the petitioner.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) submitted that the petitioner was preparing to commit dacoity from the pedestrians by using chilli powder and iron rod. He further submitted that the charge sheet is filed and there is one previous case pending against the petitioner. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, since the charge sheet is filed, there is no apprehension of arrest at the hands of the respondent police. However liberty is granted to the petitioner to workout his remedy in accordance with law.

6. Accordingly, this petition seeking anticipatory bail stands dismissed.
