The petitioner is the wife. She seeks for transfer of G.W.O.P. No. 1268 of 2021 from the file of the Family Court at Madurai to the file of the Family 1/4

Court at Coimbatore.

2. Notice was ordered in this transfer petition on 25.07.2024. Despite notice has been served, the respondent husband has not entered appearance.

3. The petitioner married the respondent on 28.10.2012 seeking restitution of conjugal rights. She has filed H.M.O.P. No. 380 of 2022 on the file of the Family Court at Coimbatore. In the meantime, the husband has initiated proceedings to appointing as the guardian for the minor child, who was born on 02.11.2016. The child is said to be studying at Corporation Primary School at Coimbatore. Since the child is residing at Coimbatore, the best interest of the child will be served, if the proceedings are transferred from the Family Court at Madurai to the file of the Family Court at Coimbatore.

4. In the light of the above discussion, G.W.O.P. No. 1268 of 2021 is withdrawn from the file of the Family Court at Madurai to the file of the Family Court at Coimbatore. Accordingly, the transfer civil miscellaneous petition is allowed. No costs. Consequently, the connected miscellaneous petition is closed.
