PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to appoint the petitioners as Special Teachers pursuant to G.O.Ms.No.164, School Education (Tho.Ka.2(2)) Department dated 29.09.2022, by considering the representations of the petitioners dated 22.06.2022, 23.06.2022, 24.06.2022, 25.06.2022, 27.06.2022, 28.06.2022, 01.07.2022, 08.07.2022, 12.07.2022, 18.07.2022, 20.07.2022, 26.07.2022, 11.08.2022, 13.08.2022, 16.08.2022, 20.08.2022, 23.08.2022, 17.09.2022, 19.09.2022, 29.09.2022 and 29.11.2022. ORDER
Heard Mr.V.Sivalingam, learned senior counsel appearing on behalf of the counsel on record for the petitioner, Mr.M.Bindran, learned Additional Government Pleader appearing for Respondents 1, 2 and 4 to 4/8
9 and Mr.Su.Srinivasan, learned Standing Counsel for third respondent.
2. The petitioners herein had given representations to the respondents to appointment them as Special Teachers pursuant to G.O.Ms.No.164, School Education (Tho.Ka.2(2)) Department dated 29.09.2022. Since the said representations were not considered, the petitioners are before this Court.
3. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon them to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representations by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of the India and direct them to consider the same within a stipulated time. 5/8

In the light of the above observations, there shall be a direction to the respondents to consider the petitioners' representation dated 22.06.2022, 23.06.2022, 24.06.2022, 25.06.2022, 27.06.2022, 28.06.2022, 01.07.2022, 08.07.2022, 12.07.2022, 18.07.2022, 20.07.2022, 26.07.2022, 11.08.2022, 13.08.2022, 16.08.2022, 20.08.2022, 23.08.2022, 17.09.2022, 19.09.2022, 29.09.2022 and 29.11.2022, on its own merits and pass appropriate orders in accordance with law within a period of three months from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any of its views with regard to the merits of the claim made by the petitioners and that it is open to the concerned respondent to consider the same on its own merits.
5. With the above direction, the Writ Petition stands disposed of. No costs.
