This petition has been filed to clarify the order passed by this Court in the main criminal original petition on 01.02.2021. This Court while passing the order, took into consideration the fact that there was no FIR registered and in spite of the same, the police was interfering with the property dispute. Therefore, this Court directed the respondent police not to interfere with the property dispute. It is to be borne in mind that this direction was issued at a stage where there was no FIR registered on the complaint given by the defacto complainant.

2.It is made clear that, if really the complaint given by the defacto complainant makes out a cognizable offence, it will be left open to the police to proceed further in accordance with law. With this clarification, this petition is closed. 11.02.2022 ssr https://www.mhc.tn.gov.in/judis
