ORDER

This Criminal Original Petition has been filed by the petitioner on 11.05.2026 under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023 praying to grant bail.

The petitioner, who was secured under a P.T. warrant and arrested on 11.08.2025 pursuant to the execution of a non-bailable warrant issued by the learned Judicial Magistrate No.II, Krishnagiri, in C.C.No.267 of 2020 in connection with Crime No.238 of 2019 on the file of the respondent police, for the offences under Sections 454 and 380 of India Penal Code, 1860, seeks bail.

3. Mr.G.Vijaya Prabhakaran, learned counsel for the petitioner, submits that the petitioner is facing trial in C.C.No.267 of 2020 on the file of the learned Judicial Magistrate No.II, Krishnagiri. He further submits that the petitioner was regularly appearing before the trial Court on all hearing dates. However, he was arrested and remanded to judicial custody in another case in Crime No.91 of 2025, due to which, he was unable to appear before the trial Court, and hence, a non-bailable warrant was issued against him and pursuant to the same, he was arrested on 2/6

11.08.2025. He also submits that the petitioner undertakes to appear before the trial Court on all hearing dates without fail and will cooperate for the speedy conduct of the trial. Hence, he prays for grant of bail to the petitioner.

Per contra, Mr.L.Baskaran, learned Government Advocate (Criminal Side) appearing for the respondent-police submits that the petitioner was earlier arrested and released on bail, but thereafter failed to appear before the trial Court. In the meantime, the petitioner got involved in another case and was remanded to judicial custody. Since he did not appear before the trial Court in the present case during that period, a nonbailable warrant was issued against him, pursuant to which a P.T. warrant was also issued and he was produced before the trial Court. He would further submit that there are 64 previous cases pending against the petitioner and therefore prays for dismissal of the petition.

5. Heard on both sides. This Court has perused the records.

6. Considering the bad antecedents of the petitioner and the likelihood that he may abscond if enlarged on bail, thereby causing delay in the trial proceedings, this Court is not inclined to grant bail to the 3/6

petitioner. However, the petitioner and the prosecution are directed to cooperate with the Trial Court and for the expeditious disposal of the case.

7. Accordingly, this Criminal Original Petition is dismissed. 20.05.2026 dpa Note:
