Prayer: Criminal Original petition filed under Section 482 of Code of Criminal Procedure, to direct the respondent Police not to harass the petitioner upon the so called undertaking which was forcefully obtained by him from the petitioner on 01.05.2019 under duress as to pay a money to one Mrs.Sivanantham, wife of Kandasamy, Jayankondam, for which the petitioner has no legal obligation.

ORDER

This Criminal Original Petition has been filed to direct the respondent Police not to harass the petitioner upon the so called undertaking which was forcefully obtained by him from the petitioner on 01.05.2019 under duress as to pay a money to one Mrs.Sivanantham, wife of Kandasamy, Jayankondam, for which the petitioner has no legal obligation.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent.

3. Taking into consideration the nature of the dispute involved in this case is a money dispute, it is for the parties to adjudicate the same before the appropriate Civil Court and the respondent police will have no role to play in a case of this nature.

4. This Criminal Original Petition is disposed of with a direction to the respondent police not to interfere with the money dispute and it is open for the parties to agitate their rights before the competent civil court.
