This application has been filed to set aside and restore the suit dismissed for default on 17.09.2019 in the above suit.

2. The learned counsel for the respondents has submitted that he has no objection in allowing this application.

3. Recording the no objection submitted by the learned counsel for the respondents and being satisfied with the reasons stated in the affidavit filed in support of this application, this application is allowed and TOS.No.38 of 2011 is restored to file.

4. Post the Suit on 06.10.2023.
