Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to protect the north-south water channel that lies on the eastern portion of Survey Number 53/5 to irrigate the petitioner's land in Survey No.55/2A1 with an extent of 0.52.0 Hec in Sivaiyam Village, Chidambaram Taluk, Cuddalore District by considering the petitioner's representation dated 11.08.2022 which was numbered as petition No.3190/2022 by the first respondent. ORDER

Since no adverse Order has been passed as against the third and fourth respondents, notice to them is dispensed with. With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This Writ Petition is filed to direct the first respondent to protect the north-south water channel that lies on the eastern portion of Survey Number 53/5 to irrigate the petitioner's land in Survey No.55/2A1 with an extent of 0.52.0 Hec in Sivaiyam Village, Chidambaram Taluk, Cuddalore District by considering the petitioner's representation dated 11.08.2022 which was numbered as petition No.3190/2022 by the first respondent.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the first and second respondents and perused the materials available on record.

4. The case of the petitioner is that herself and her husband had wetland in survey Numbers 53/5 to an extent of 0.52.0 Hec. And 55/2A1 to an extent of 0.52.0 Hec. in Sivaiyam Village, Chidambaram Taluk and the 2/5

petitioner sold their land in Survey No.53/5 to an extent of 0.52.0 to the third and fourth respondents and retained their land in Survey No.55/2A1 and they are doing agriculture in the said land. While so the third and fourth respondents are preventing the petitioner from taking water to her land. In this regard the petitioner has made a representation to the first and second respondents. But the same has not been considered by the first and second respondents till date. Hence, the present Writ Petition.

Considering the limited relief sought for in this writ petition, the first respondent is directed to consider the representation of the petitioner 11.08.2022 which was numbered as petition No.3190/2022 and pass appropriate orders on the same on merits and in accordance with law, after issuing notice to the third and fourth respondents, within a period of two months from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs.
