The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 323, 324 and 506(ii) of IPC in Crime No.162 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant/Anand is that, on 14.05.2023 at about 6.30 p.m, when the defacto complainant and his brother were playing cricket, the petitioner along with other accused quarrelled with each other, at that time, the defacto complainant and his brother tried to pacify the quarrel, for which, the petitioner abused them with filthy language and assaulted the defacto complainant with beer bottle and caused injuries to him and also threatened him with dire consequences. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that due to previous enmity, a false complaint has been given against the petitioner. Hence, he prayed for grant of anticipatory bail to

the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that when the defacto complainant and his brother were playing cricket, the petitioner along with other accused quarreled with each other, at that time, the defacto complainant tried to intervene the quarrel, for which, the petitioner assaulted the defacto complainant with beer bottle and thereby causing injuries to him. He further submitted that there are nine previous cases pending as against the petitioner. Hence, he opposed for granting anticipatory bail to the petitioner.

5. Heard the learned counsel on both sides and perused the entire materials available on record including the First Information Report.

Taking into consideration the allegations and also the bad antecedent of the petitioner and it is stated that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 28.06.2023 drl
