The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 454 and 380 of IPC in Crime No. 800 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant bought a flat - 4BHK from one Usha Rajagopal. The flat was partitioned of which one portion was given to one of the Company staff of the defacto complainant and the other part is used by one Bharani Velan, son of Usha Rajagopal. The said Bharani Velan is a business man and alleged to have kept 4,50,00,000/- and 30 Sovereign of Gold Jewellery in his portion. On 19.11.2021, the defacto complainant was informed by her staff that four persons were trying to open the flat's main door on 18.11.2021 as well as on 19.11.2021, when neighbour questioned him, they said that they have come for carrying out some repair work inside of the house. On the defacto complainant's reply that she has not engaged anybody for carrying out any repair work, the defacto complainant went to the flat on 20.11.2021 and found that the lock of the inner room was broken and the cash as well as the gold jewels were missing. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Therefore, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that this is the third anticipatory bail filed by the petitioner. In this case, the petitioner is arrayed as A10. The petitioner, along with other accused, had committed theft of Rs.4,50,00,000/- and 30 Sovereign of Gold Jewellery. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the above fact and circumstances of the case, custodial interrogation of the petitioner is very much required and hence this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 28.07.2022 Lpp
