Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of mandamus directing the respondents to depute the petitioners for six month training for promotion to the post of Health Inspector Grade-II, as per Government orders, by considering the petitioner's representation dated 28.08.2017.

ORDER

The grievance of the petitioners in this case is that they are working as Basic Health Workers / Male Nursing Assistants in different hospitals and have rendered more than 10 years of service, though the Government in the meanwhile has taken a decision to impart training if they have requisite qualification for their promotion to the higher cadre, but the petitioners are not being sent for training. In this regard, they have made a representation to the second respondent on 28.08.2017, but no decision on the same yet been taken. Hence, they have filed this writ petition challenging the inaction of the second respondent in considering their representation to send them to training.

2. In spite of notice given, no counter affidavit has been filed. However Mr.V.Kadhirvelu, learned Special Government Pleader for the respondents would submit that the respondent No.2 shall have no objection for consideration of such representation in accordance with law.

3. Considering the facts and submissions made, no useful purpose is going to be served by keeping the writ petition pending. Hence, this Court after hearing the counsel for the parties and going through the materials on record disposes of this writ petition with the direction to the respondent No.2 to take an informed and considered decision on the representation of the petitioners made on 28.08.2017 with regard to sending them to training, within a period of six weeks from the date of receipt of a copy of this Order.

4. Needless to say that the order of this Court in this regard shall not be considered as mandate to dispose of the representation dated 28.08.2017 in any particular manner.

5. With the aforesaid order, this writ petition is disposed of. However, in the circumstances there shall be no order as to costs.
