PRAYER: Writ petition has been filed under Article 226 of Constitution of India, to issue a writ of mandamus directing the 2nd Respondent not to harass the petitioner and investigate the petitioner's complaint dated 03.09.2021 in proper manner. For Petitioner :

ORDER

The writ petition has been filed to direct the 2nd Respondent not to harass the petitioner and investigate the petitioner's complaint dated 03.09.2021.

2.The petitioner and the third respondent Ravi are cosharers in the undivided property. One of the co-sharers T.Ponnalagi had filed a suit in C.S.No.198/2004, in which, the petitioner's father Subbaiah is one of the defendants. Earlier, the petitioner was not allowed to enjoy the property and further, without the knowledge of the petitioner and other share holders, some transactions have taken place with regard to the property. Earlier, on a complaint given by the third respondent, the petitioner was called for enquiry and appeared before the respondent police and gave his explanations, with regard to the https://hcservices.ecourts.gov.in/hcservices/

document and Court orders. Thereafter, the petitioner was not aware of the outcome of the complaint and now, he is again called for enquiry. Hence, the above petition. 3.The learned Additional Public Prosecutor submits that on the complaint given by Ravikumar, CSR No.535 of 2021 assigned. The petitioner as well as the said Ravikumar called for enquiry and later, the case was closed. The petitioner had lodged a complaint on 07.09.2021, CSR No.592 of 2021 assigned. The petitioner is called for enquiry with regard to his complaint dated 07.09.2021.

4.Considering the submissions and finding that, the petitioner has been called for enquiry to substantiate the complaint along with the documents in support of his contention in CSR No.592 of 2021 cannot be termed as harassment.
