PRAYER: This Writ Petition has been filed under Article 226 of the Constitution of India, praying for issuance of a writ of Mandamus, directing the respondents to accept the proposal submitted by the petitioner for the exchange of its patta lands comprised in survey Nos.143, 144, 146/1A, 146/1B, 146/ 2A1 and S.No.127, admeasuring a total extent of 6.03 acres, instead of the land comprised in survey Nos.147/2 and 147/3, measuring a total extent of 5.51 acres, classified as Meikaal Poramboke, both situated at No.50, Periya Obulapuram Village, Gummidipoondi Taluk, Thiruvallur District, by considering the petitioner's representation dated 17.02.2025 , in light of GO (MS).No.201, Revenue and Disaster Management Department dated 10.05.2022, within a time frame fixed by this Court. ORDER

The present writ petition has been filed for issuance of a writ of mandamus to direct the respondents to accept the proposal submitted by the petitioner for the exchange of its patta lands comprised in survey Nos.143, 144, 146/1A, 146/1B, 146/ 2A1 and S.No.127, admeasuring a total extent of 6.03 acres, instead of the land comprised in survey Nos.147/2 and 147/3, measuring a total extent of 5.51 acres, classified as Meikkal Poramboke, 2/7

both situated at No.50, Periya Obulapuram Village, Gummidipoondi Taluk, Thiruvallur District, by considering the petitioner's representation dated 17.02.2025, in light of GO (MS).No.201, Revenue and Disaster Management Department dated 10.05.2022, within a time frame fixed by this Court.

At the outset, it is submitted by Mr.A.Selvendran, learned Special Government Pleader for the respondents that the petitioner's representation dated 17.02.2025 would be considered, keeping in view the relevant Government Order and also judicial orders, including a Division Bench order of this Court dated 02.02.2022 passed in W.P.No.19286 of 2021 and orders would be passed, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

3. In view of the limited relief that is prayed, this court is inclined to issue the following directions:

(i) The respondents shall consider the representation of the petitioner dated 17.02.2025 taking into account the relevant 3/7

Government Order as well as the judicial orders, including the order passed by the Division Bench of this Court in W.P.No.19286 of 2021, dated 02.02.2022.

(ii) The petitioner's representation shall be considered and disposed of, as expeditiously as possible, after affording a reasonable opportunity of hearing to the petitioner and all other interested parties.

(iii) Though facts have been set out in affidavit, in view of the limited relief that is sought to be granted, I do not propose to examine the same, lest it may influence the authority. The authority shall independently consider the facts set out in the representation and pass appropriate orders in accordance with law, as stated supra.

(iv) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the respondent concerned to consider the matter on its own 4/7

merits and in accordance with law.

(v) Rights and contentions of the petitioner and all other interested parties are left open.
