PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing respondents 1 and 2 to recover the amount as per the certificate issued on 30.05.2022 by the Deputy Commissioner of Labour, Salem as on date and to remit the same 1/4

ORDER
Heard Mr.T.Pichappa, learned counsel for the petitioner, Mr.P.Sathish, learned Additional Government Pleader for respondents 1 and 2 and Mr.K.Raja, learned Standing Counsel for the third respondent. 2.Based on the Certificate dated 30.05.2022, issued by the Deputy Commissioner of Labour Court, Salem, the petitioner seeks for an issuance of a Mandamus directing respondents 1 and 2 to recover the amount under the provisions of the Revenue Recovery Act. 3.Today, when the matter is called, the learned Additional Government Pleader appearing for respondents 1 and 2, on instructions, submitted that a sum of Rs.1,84,527/- has been recovered from the 2/4
Transport Corporation and the same is now lying in deposit before the Deputy Commissioner of Labour, Salem.
4.According to the third respondent, the amount, which has now been deposited, is the total amount due to the petitioner. 5.In view of the submissions made, the petitioner is granted liberty to make an Application before the Deputy Commissioner of Labour, Salem seeking for withdrawal of the entire amount, lying in deposit and on receipt of such application, the Deputy Commissioner of Labour, Salem shall forthwith pass orders, permitting the petitioner to withdraw the amount, preferably on the same day of the Application. 6.With the above observation, the writ petition stands disposed of. No costs.
