This Criminal Original Petition has been filed by the petitioner on 19.05.2026 under Sections 6(4) of TNSC (RCDS) Order 1982, read with Section 7(1) a (ii) of Essential Commodities Act, 1955 praying to grant an order of pre-arrest bail.
2. The petitioner / Accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) of TNSC (RCDS) Order 1982, read with Section 7(1) a (ii) of Essential Commodities Act, 1955 in Crime No.41 of 2026 on the file of the respondent police.
3.The case of the prosecution is that on 19.02.2026, when the respondent police was on regular patrol found that the petitioner was illegally transporting 12,500 kgs of PDS Rice in 250 bags (each containing 50 kgs) by using two lorries. Hence the case.
4. Mr. N. Sathish Kumar, learned counsel appearing on behalf of the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. However, he submits that the petitioner is ready to 2/8
abide by any conditions to be imposed by this Court. Hence he prays to grant an order of pre-arrest bail to the petitioner.

Per contra, Mr.A.Gopinath, the learned Government Advocate (Criminal Side) appearing on behalf of the respondent - Police submits that the petitioner was illegally transporting 12,500 kgs of PDS Rice in 250 bags in two lorries each containing 50 kgs. He further submits that this is the third anticipatory bail application and if pre-arrest bail is granted to the petitioner, he will commit similar type of offence. He therefore prays to dismiss this Criminal Original Petition.
6. Heard on both sides. This Court has perused the records.
7. Considering the facts and circumstances of the case, the nature of the offences; and that the petitioner has permanent residence and deep roots in society; there is less possibility of absconding; and also considering the fact that the petitioner is a first offender and also taking into account of the fact that the petitioner is ready to deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) and with a view to give an opportunity to the petitioner to reform himself, this Court is inclined to grant pre-arrest bail to the petitioner. Accordingly, pre-arrest bail is granted to the petitioner subject to the following 3/8
conditions:
(i) The petitioner shall be released on pre-arrest bail in the event of his arrest or in the event of his surrender before the learned Judicial Magistrate No.IV, Vellore, Vellore District, within a period of 15 days from the date on which the order copy is made ready, on executing a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) along with two sureties each for a like sum of Rs.50,000/- (Rupees Fifty Thousand only) to the satisfaction of the learned Judicial Magistrate No.IV, Vellore, Vellore District. (ii) The sureties shall affix their photographs and left thumb impression in the Application for Suretyship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Judicial Magistrate No.IV, Vellore, Vellore District, shall obtain a copy of any one of their identity proofs to ensure their identity.
(iii) The petitioner is directed to deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) within a period of 15 days from today to the credit of Tamil Nadu Advocate's Clerk's Association, Madras High Court, High Court Building, Chennai-104 (Account Name: TN Advocate's Clerk's Association Account No:- 484026006; Branch: Indian Bank, High Court; IFSC Code:- IDIB000M157), without prejudice to his rights and contentions 4/8
before the Trial Court. Only upon deposit, the learned Judicial Magistrate No.IV, Vellore, Vellore District shall accept the sureties. (iv) The petitioner shall appear and sign before the respondent Police, twice in a week i.e., on every Monday and Friday at 10.00 a.m., until further orders;
(v) The petitioner shall make himself available for interrogation by a police officer as and when required.
(vi) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer or tamper with the evidence.
(vii) The petitioner shall also not, directly or indirectly, cause any threat to the witnesses and shall not tamper the evidence (viii) The petitioner shall furnish their residential address and mobile number to the learned Judicial Magistrate No.IV, Vellore, Vellore District. (ix) On breach of any of the aforementioned conditions, the learned Judicial Magistrate No.IV, Vellore, Vellore District or Trial Court, as the case may be, is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions are imposed by them 5/8
as laid down by the Hon'ble Supreme Court in P.K. Shaji vs. State of Kerala [(2005) 13 SCC 283].
8. Accordingly, this Criminal Original Petition is allowed subject to the conditions stated supra.
