ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.11.2025 for the alleged offences under Sections 5 (l) r/w 6 and 11 (3) r/w 12 of POCSO Act, 2012 and Section 351 (2) of BNS Act, 2023, in Crime No.26 of 2019 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was working as a warden in a boys hostel and he had committed sexual assault against the nine victim boys. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 15.11.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police produced the victim's statement recorded under Section 183 of the BNSS, which contains serious allegations against the petitioner. He further submitted that, if the petitioner is released on bail, there is a strong possibility that he will tamper with the witnesses during their examination. Hence, the learned Government Advocate opposed for grant of bail to the petitioner.

5.As rightly contended by the learned Government Advocate, if the petitioner is enlarged on bail, there is a strong possibility of witness tampering during the examination of witnesses. Hence, this is not a fit case to enlarge the petitioner on bail.
