2. It is represented by the learned counsel appearing for the plaintiff that the suit has been settled out of Court and accordingly, seeks permission to withdraw the suit.
3. An endorsement has also been made by the learned counsel for the plaintiff in the plaint to that effect.
4. In the light of the above position, the Civil Suit is dismissed as settled out of Court. Consequently, connected original application is closed. No costs.
5. Registry is directed to refund the half of the Court fee, if rules permit.
