Crl.O.P.No.15184 of 2024 T.V.THAMILSELVI, J.

The petitioners, who were arrested and remanded to judicial custody on 13.06.2024 in Crime No.179 of 2024, for the alleged offences punishable under Section 273, 328 of IPC and Section 7, 20(2) of Cigarette and other Tobacco Products Act, 2003 and Section 77 of Juvenile Justice (Care and Protection of Children Act), 2015, seek bail.

2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case, as it is alleged that the petitioners along with other accused possessed banned tobacco products. He further submitted that the petitioners are suffering incarceration from 13.06.2024 and they are ready to abide any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioners.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioners stating that the petitioners along with other accused was found in illegal T.V.THAMILSELVI, J.

drl possession of 725 kgs of banned tobacco products with intention to sell the same near school premises. He further submitted that the petitioner/A6 is still absconding, and he has two previous cases, which are similar in nature are pending. He further submitted that the investigation is still pending.

4. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) and perused the materials available on record.

5. Considering the allegation against the petitioners and also considering the fact that the petitioners/A6 is not yet secured, and the stage of the investigation, this Court is not inclined to grant bail to the petitioners.

6. Accordingly, this Criminal Original Petition stands dismissed.
