2. In this matter, an ex parte decree was passed earlier on 17.08.2017.

A.No.8461 of 2017 is for setting aside the ex parte decree. This has been recorded vide sub-paragraph (c) of Paragraph 4 of judgment dated 09.12.2019.

3. However, for the purpose of eliminating any procedural difficulty in drafting the decree, it is made clear that ex parte decree dated 17.08.2017 made in C.S.No.611 of 2012 is set aside and compromise decree dated 09.12.2019 in terms of Memo of Compromise dated 20.11.2019 will substitute the ex parte decree and the compromise decree will be the lone decree in the instant suit.

Thus clarified and this shall be read as part of the judgment dated 09.12.2019 and the decree to be drafted accordingly.
