The petitioner filed a complaint against the respondent before the Judicial Magistrate, Fast Track Court, Ambattur, in C.C.No.220 of 2017 for the offence under Sections 138 & 142 of Negotiable Instruments Act, 1881. The learned Magistrate, after the trial, dismissed the case. Challenging the same, the petitioner filed an appeal before the III Additional District & Sessions Judge, Thiruvallur in C.A.No.149 of 2018 and the same was dismissed. Challenging the same, he filed a present petition before this Court to grant leave for preferring the criminal appeal.

2. Having been satisfied with the reasons assigned in the affidavit filed in support of this appeal, the leave is granted.

3. The Registry is directed to take the appeal on file, if the same is otherwise in order and thereafter, call for records from the Court below within a week. The petitioner is directed to prepare the typed set of papers and serve a copy of the same to the other side.

List the matter on 18.03.2021.
