Mr.Ramasamy Meyyappan for R-1 * * * * * COMMON ORDER (Order of the Court was made by Senthilkumar Ramamoorthy, J.) The writ petitioner had prayed for 15 days emergency leave for her husband, M.Ashish Sharma, who is a convict confined at Central Prison, Puzhal. By order dated 21.05.2025, this Court granted 15 days emergency leave with two escort personnel. By the present petitions, one filed by the

writ petitioner and the other by the Superintendent of Central Prisons, modification of the said order dated 21.05.2025 is requested for.

2. The reason mentioned is that it becomes difficult for the Tamil Nadu police personnel to continue to provide the escort after the convict reaches Uttar Pradesh.

3. The learned Additional Public Prosecutor refers to an earlier order dated 03.04.2025 passed in Crl.A.No.1235 of 2024.

4. Upon considering the aforesaid, we are inclined to modify the order dated 21.05.2025 passed in the writ petition, to the extent specified below:

1) Mr.Ashish Sharma shall be released at 10.00 a.m. on 30.05.2025 along with two escort personnel, who will accompany the convict to the State of Uttar Pradesh;

2) Sri.Shlok Kumar Singh, Senior Superintendent of Police, Mathura District, and Sri.Devpal Singh, Inspector of Police, Kotwali Police

Station, Mathura District, are directed to take over the escort responsibility from AR II, Greater Chennai Police, upon the convict being entrusted to their responsibility.

3) The escort personnel assigned by the Senior Superintendent of Police, Mathura District, shall accompany the convict until he is brought back to the Central Prison, Puzhal, at 5.00 p.m. on 15.06.2025.

4) All expenses in relation to the escort shall be borne by the writ petitioner.

Both the petitions are ordered accordingly.
