These Miscellaneous petitions have been filed seeking necessary orders of this Court directing the Metropolitan Magistrate, Fast Track CourtIII, Saidapet, Chennai to accept the deposits made by the petitioner and also to accept the Bonds, Surrender petitions and Sureties produced by the petitioner for his surrender and release, pending disposal of the above Criminal revision petitions.
2. Learned counsel for the petitioner submitted that, this Court, vide common order dated 30.04.2024 made in Crl.MP.Nos.7215 of 2024 and etc., batch of cases, suspended the respective substantive sentence of imprisonment on certain conditions. When the petitioner appeared before the trial court for complying the order of this court, the trial court had refused to accept the deposits and surrender papers produced by the petitioner on the ground that, the petitioner has to obtain suitable clarificatory orders from this Hon'ble Court in respect of the petitioner's name. He further submitted that, the petitioner has changed his name from AL.Kumar to AL.Alagappan, 1/4
which has been published in the Tamil Nadu Government Gazette dated 14.01.2009, which is much prior to the initiation of the criminal proceedings and all his identity documents stand in his changed name i.e., AL.Alagappan. However, as his name was mentioned as AL.Kumar in the proceedings instituted before the Trial court as well as the lower appellate court, the petitioner maintained the same in the cause list of the above criminal revisions. Thereby, the petitioner mentioned his name as AL.Kumar in the deposits and surrender papers, however, as his name is mentioned as AL.Alagappan in the identity documents, the trial court refused to accept the same. Accordingly, he prayed for appropriate orders of this Court in respect of clarification of the petitioner's name.
3. Learned Government Advocate (Crl. Side) fairly submitted that the petitioner has changed his name, but in the criminal proceedings his name has been shown as A.L.Kumar. Therefore, this Court may pass appropriate orders.
4. Satisfied with the reasons stated in the affidavit filed in support of the petitions, this Court considers it appropriate to allow these petitions 2/4
and, accordingly, the trial court is directed to receive the bonds, sureties, etc., submitted by the petitioner herein, who is shown in the criminal proceedings as A.L.Kumar, but whose name has since been changed as A.L.Alagappan, as is reflected in the documents.
5. The present petitions are allowed and the trial court is directed to accept the deposits made by the petitioner as well as the Bonds, Surrender petitions and Sureties produced by the petitioner. Time is extended by a further period of two weeks from the date of receipt of a copy of this order for the petitioner herein to comply with the order of this Court dated 30.04.2024.
6. Accordingly, these Criminal Miscellaneous petitions are ordered.
