Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of certiorarified mandamus calling for the records of the 2nd respondent in connection with the impugned order passed him in Na.Ka.21499/2015/B5 dated 07.04.2016 and quash the same and further direct the respondents to survey the petitioner land and fix the boundary within reasonable time.

ORDER

The learned counsel for the petitioner, after some arguments, seeks permission of this Court to withdraw this writ petition with a liberty to file an appeal before the Revenue Divisional Officer, Rasipuram, Namakkal District and also made an endorsement to that effect.

2 In the light of the endorsement made, this writ petition is dismissed as withdrawn and the petitioner is at liberty to file an appeal before the Revenue Divisional Officer, Rasipuram, Namakkal District, along with a petition for stay and if the papers are otherwise in order, the said official is directed to entertain the appeal and take up the petition for stay initially and dispose of the same as expeditiously as possible within a period of two weeks from the date of entertainment of the appeal petition. No costs.
