ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.04.2025, for the offence punishable under Section 331 (4) and 305 (a) of BNS in connection with Crime No.33 of 2025, registered on the file of the respondent, seeks bail. 2.The contention of the learned counsel for the petitioner is that A1 in this case is a friend of the petitioner and for that reason he had been arrested. Petitioner is from the

state of Bihar. He has been doing manual works in Chennai. Since, the petitioner had some language problem, he was unable to properly give answers during enquiry and hence he had been arrested and he is in judicial custody from 26.04.2025. Hence, he prays for grant of bail to the petitioner.

3.The learned Government Advocate (Criminal side) submitted that in this case petitioner along with another accused had climbed over the fourth floor of Kumaran Silks, T.Nagar, Chennai, on the intervening night of 16.02.2025 and 17.02.2025 and had stolen a sum of Rs.3,50,000/- by broking open the cash box. A1 in this case is still absconding. A special team has been formed to secure A1 and also to find out whether any other persons have been involved in this case. Investigation in this case is not completed. Hence, he strongly opposed the grant of bail to the petitioner. 4.Heard the learned counsels on either side and perused the material records. 5.Considering the nature of offence, the fact that investigation in this case is not completed and the other accused is still absconding, and the fact that still a sum of Rs.

3,50,000/- is not recovered, this Court is of the view that, if the petitioner is released on bail, he will abscond to his native state of Bihar. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
