The plaintiff seeks leave to institute the suit, which is for recovery of money being the value of the goods sold and delivered.

2. According to the plaintiff, the goods were sold at Chennai and the conditions of sale agreed to by the defendant invests this Court with jurisdiction. Since the defendant is carrying on businesses outside the original jurisdiction of this Court, the plaintiff has come forward with this application seeking leave to institute the suit.
