W.M.P.No.19248 of 2023 in W.P.No.33328 of 2022 S.SOUNTHAR, J.

This petition is filed seeking modification of the order passed by this Court dated 09.11.2022 delegating cheque signing power to 2nd respondent along with the petitioner.

2. In the affidavit filed in support of this petition, it is stated by the petitioner that the 2nd respondent is Assistant Director(Panchayat), Nagapattinam District and he is having control over 193 Village Panchayats comprised of 6 Panchayat Unions in Nagapattinam District. Hence, frequent travel to Village Panchayat for the purpose of signing cheques will certainly affect the regular work of the Assistant Director of the Village Panchayat. Therefore, the petitioner seeks modification of the order by authorizing the 6th respondent herein to sign the cheques along with the petitioner.

3. The petitioner is unable to dispute the facts pleaded in the affidavit filed in support of this petition regarding the work load of the 2nd respondent. In such circumstances, having regard to the reasons assigned in support of the affidavit, this Court is inclined to modify the oder passed in W.P.No.33328 of 2022 and W.M.P.No.32770 of 2022 dated 09.01.2023 by authorizing the 6th respondent herein to sign the cheques along with the petitioner.
