ORDER

The petitioners/A2 and A7 apprehend arrest for the alleged offence under Sections 303(2) of BNS 2023, r/w 21(1) of Mines and Minerals (Development & Regulation) Act in Crime No.70 of 2026 on the file of the respondent police seek anticipatory bail.

2. The case of the prosecution is that the petitioners were involved in illegal transportation of 24 units of river sand in a lorry without any valid licence. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that the petitioners are ready to abide by any stringent condition that may be imposed by this Court and they are ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioners.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that there is one previous case of similar nature, pending against the petitioners. He further submitted that the petitioner's earlier anticipatory bail petition was dismissed by this Court vide order dated 27.03.2026 in

Crl.OP.No.7819 of 2026. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

5. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) for the respondent.

6. From the submissions made by the learned Government Advocate (Crl.Side) it is seen that there is one previous case pending against the petitioners, this indicates their antecedents and raises a reasonable apprehension that they may indulge in similar offence, if enlarged on anticipatory bail and there is no change of circumstances after the dismissal of the petitioner's earlier anticipatory bail petition, Hence, this Court is of the firm view that the petitioners do not deserve anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 05-06-2026 VV To
