Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorarified Mandamus to call for records of the first respondent, dated 30.01.2018 and to quash the same and consequently, to direct the first respondent to accept the resignation letter of the petitioner, dated 23.12.2017 from them and issue her the order of acceptance to it and relieve the petitioner from the service and issue her service certificate for her working period form 03.07.2006 to 01.03.2018 under them.

Since this Writ Petition it taken up for disposal at the stage of admission itself and considering the nature of relief to be granted herein, this Court is of the view that notice to the second respondent shall be dispensed with. 2.

The learned counsel appearing for the petitioner has submitted that though the petitioner has filed this Writ Petition challenging the inaction on the part of the first respondent in not accepting her letter of resignation, but, in https://hcservices.ecourts.gov.in/hcservices/

the meanwhile, on 13.06.2018, the first respondent has already given a direction to relieve the petitioner from service. However, the learned counsel submits that the petitioner wants to be relieved from an anterior date, but such a prayer been not included in the Writ Petition, therefore, the learned counsel, at this stage, wants to withdraw the Writ Petition with submission that liberty may be given to the petitioner to challenge the inaction of the first respondent in not accepting her resignation from an anterior date. Endorsement in this regard has been made in the Writ Petition. But it brought to the notice of this Court by the learned counsel though the petitioner has worked for nearly 12 years with the first respondent, no experience certificate has been given to her.

In reply, the learned counsel appearing for the first respondent submits that the first respondent will issue such experience certificate within a week. Recording such submission, this Writ Petition stands disposed of being withdrawn giving liberty to the writ petitioner to file a fresh Writ Petition seeking the relief as stated. However, there shall be no order as to costs.
