ORDER
The petitioner apprehends arrest for the alleged offence under Sections 296(b), 115(2), 118(1), 351(3) and 140(3) of Bharatiya Nyaya Sanhita, 2023 in Crime No.213 of 2026 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that due to previous enmity, the petitioners along with other accused kidnapped the defacto complainant and abused her in a filthy language. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner are innocent and they have been falsely implicated in this case. He further submitted that the petitioners are ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioners have committed serious offence and therefore, if anticipatory bail is granted, it would affect the morale of the society. Hence, she opposed to grant anticipatory bail to the petitioner.
5. Taking into consideration the nature of the allegation against the petitioner and the submissions made by the learned Government Advocate (Criminal Side), this Court is not inclined to enlarge the petitioner on anticipatory bail.
