Writ Petition filed under Article 226 of the Constitution of India praying to issue an appropriate order or direction or Writ of Mandamus to direct the respondent to permit the petitioner for promotion under Career Advancement Scheme for the year 2019 by allowing the petitioner to participate in the interview and to promote the petitioner to the post of Assistant Professor to Associate Professor and Associate Professor to Professor (two stages) as per the application submitted by the petitioner August 2018.

The petitioner filed this Writ Petition seeking to direct the respondent to permit the petitioner for promotion under Career Advancement Scheme for the year 2019 by allowing the petitioner to participate in the interview and to promote the petitioner to the post of Assistant Professor to Associate Professor and Associate Professor to Professor (two stages) as per the application submitted by the petitioner in August 2018.

The case of the petitioner is that the petitioner was appointed as Lecturer in Respondent University on 20.07.2000, issued with confirmation order by the Respondent in the post of Lecturer vide proceedings dated 09.02.2001 and his services have been regularized from the date of appointment and probation was also declared. The post of Lecturer has been subsequently redesignated as Assistant Professor. In respect of University, the promotional opportunity is being provided periodically on participation in Career Advancement Scheme (CAS). After appointment to the post of Assistant Professor, the petitioner has successfully guided 27 M.Phil., candidates and 3 Ph.D., candidates. Apart from that he has published 20 papers in the Referred Journals. Thereafter, the respondent University has called for applications for promotion under CAS. Based on the same, the petitioner has also submitted application enclosing all the materials to the respondent through HOD. But, till date the application was not considered. Hence, the writ petition filed.
3. The learned counsel for the petitioner submitted that it would be suffice to issue a direction to the respondents to consider the application dated 12.12.2018 and pass order on merits and in accordance with law.
4. M/s.K.Sathish kumar, learned Standing Counsel appearing for the respondents conceded with the limited request made by the learned counsel for the petitioner.
5. Considering the above facts and circumstances and the limited request made by the petitioner, I am inclined to issue direction to the respondents to consider the application dated 12.12.2018 and forwarded to the HOD in accordance with Career Advancement Scheme (CAS) and pass appropriate orders in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous petition is closed. Sd/- Assistant Registrar // True Copy// Sub Assistant Registrar vsn
