A.No.2953 of 2022 in C.S.DR.No.68488 of 2022 A.No.2953 of 2022 in C.S.DR.No.68488 of 2022 KRISHNAN RAMASAMY.J., This application has been filed, seeking to grant leave to the plaintiff to sue with respect of the 'D' schedule mentioned property.
2. The suit is filed for partition and separate possession. It is stated by the applicant/plaintiff that A, B & C Schedule properties are situated within the jurisdiction of this Court and D Schedule property is situated in Thirumullaivoyal Village, which is outside the jurisdiction of this Court. Both the parties are residing within the jurisdiction of this Court. Hence, the applicant/plaintiff prays to grant leave to sue with respect of 'D' Schedule mentioned property along with 'A' to 'C' mentioned properties.
3. Considering the facts and circumstances that since the three items out of the four items situates within the jurisdiction of this Court and even the applicant and respondent are also residing within the jurisdiction of this Court, in the interest of justice, this Court is inclined to allow this application and leave to sue with respect of 'D' Schedule mentioned property along with 'A' to 'C' mentioned properties is granted.
