The petitioner namely Rajagopal, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 294(b), 342, 324 and 506(ii) IPC in Crime No.160 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime No.160 of 2023 for the offences under Sections 294(b), 342, 324 and 506(ii) IPC. Petitioner is innocent. Apprehending arrest at the hands of the respondent, this petition is filed.

3. Learned Government Advocate (Criminal side), opposes this petition, on the ground that, there is a dispute between the defacto complainant and the accused in connection with a pathway. As a result, on 07.06.2023 at about 11.30 a.m., the accused had beaten the defacto complainant with spade. The defacto complainant suffered injuries. He was treated and discharged from the hospital. Thus, he prays for dismissal of this petition.

4. Considering the submissions and perused the records.

5. It is seen from the copy of the Accident Register produced by the learned Government Advocate (Criminal side) that, the defacto complainant suffered the following injuries, (i) Stapled laceration over forehead.

(ii) Large laceration 8x3x7 cm over right parietal region of scalp, exposing parietal bone.

(iii) Large contusion over left parietal region of scalp (iv) Left eye contusion.

6. Considering the nature of the allegations made in the first information report against the petitioner and the seriousness of the injuries suffered by the defacto complainant, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
