ORDER
The petitioner, who was arrested and remanded to judicial custody on 02.03.2025 for the alleged offence punishable under Sections 305(a), 317(2), 317(4), 331(4) of the Bharatiya Nyaya Sanhita, 2023, in Crime No.547 of 2024 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused broke open the house of the de facto complainant and committed theft of 118 sovereigns of gold jewellery, 75 carats of diamond jewellery, and 1,120 US dollars. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner has been in judicial custody since 02.03.2025 and that A1 and A2 have already been enlarged on bail by this Court. He also submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing the grant of bail, reiterated the prosecution case and submitted that most of the stolen articles have been recovered and that the major portion of the investigation has already been completed.

Considering the totality of the circumstances, the period of incarceration undergone by the petitioner since 02.03.2025, the fact that the coaccused have already been enlarged on bail, and that the major portion of the investigation has already been completed, this Court is of the view that the petitioner is entitled to be enlarged on bail, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties one being a blood relative surety and the other a local surety, each for a like sum to the satisfaction of the Sessions Court for Trial of Bomb Blast Cases (FAC), Coimbatore, and subject to the following conditions: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Suretyship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall appear and sign before the Sessions Court for Trial of Bomb Blast Cases (FAC), Coimbatore daily at 10.30 a.m until further orders and shall also appear on all hearing dates without fail. It is made clear that the petitioner shall not leave the city of Coimbatore without getting prior permission from the Sessions Court for Trial of Bomb Blast Cases (FAC), Coimbatore;
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions had been imposed and the petitioner released on
bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[f] if the petitioner thereafter abscond, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023.
