Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Section 341, 294 (b), 323, 324 and 506(ii) of I.P.C subsequently altered as offences under section 341, 294(b), 323, 324, 307 and 506(ii) of I.P.C, in Crime No.2177 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons have joined together and attacked the defacto complainant with stones and iron rod. Thereby, the defacto complainant sustained injuries. Hence, the complaint.

3. The learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) submits that this is petitioner's second application and the petitioner's earlier application was dismissed by this Court on 28.07.2021 in Crl.O.P.No.12656 of 2021. However, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the gravity of the offence also the considering the fact that after the dismissal of the earlier application, there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
