The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 323 and 307 of IPC in Crime No.134 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner, along with other accused, have quarrelled with the defacto complainant. As a result, the petitioner attacked the defacto complainant with knife and thereby caused injuries to him. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and it is a case in counter. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police opposed for grant of bail to the petitioner

stating that due to previous enmity, the petitioner, along with other accused persons, have quarrelled with the defacto complainant. As a result, the petitioner attacked the defacto complainant with knife and thereby caused injuries to him. He further submitted that the injured has been discharged from the hospital. He also submitted that there are six previous cases pending against the petitioner and he is a history sheeter.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl Side) for the respondent and perused the entire materials available on record including the FIR.

6. Taking into consideration the facts and circumstances of the case and also the submissions made on both sides and also taking note of the fact that there are six previous cases pending against him, hence, this Court is not inclined to grant bail to the petitioner.
