This application has been filed to condone the delay of 1476 days in filing the written statement in T.O.S.No.2 of 2018.

2. The learned counsel for the respondent submitted that this application may be allowed subject to payment of costs as the delay is huge i.e., 1476 days.

3. The learned counsel for the applicant submitted that there is a delay of 1476 days in filing the written statement which is neither willful nor wanton but due to intervening Covid-19 pandemic situation.

4. Considering the rival submissions, this application is allowed on payment of costs of Rs.1,000/- to the respondent within a period of two weeks from today.

5. Registry is directed to receive the written statement and post the matter for framing issues after three weeks.
