This Criminal Original Petition has been filed by the petitioner/sole accused, who was arrested and remanded to judicial custody on 02.05.2024, seeking bail in Crime No.437 of 2023 registered for the offence under Section 379 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and a false case has been registered against the petitioner for statistical purpose. He further submitted that this is the second application for bail filed by the petitioner and the earlier bail application was dismissed by this Court in Crl.O.P.No.12931 of 2024 on 10.06.2024. He also stated that the petitioner has been suffering incarceration from 02.05.2024. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that the petitioner had committed theft of Rs.2,95,000/- from the de facto complainant's car. He further submitted that the case is under investigation, no recovery was made from the accused and the petitioner is a habitual offender having 4 previous cases. He also submitted that this is the second bail application of the petitioner and there is no change in circumstances. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) that the earlier bail application filed by the petitioner was dismissed only on 10.06.2024 and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
