Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent to dispose of the appeal dated 21.03.2016 filed by the petitioner within a reasonable time to be stipulated by this Court.

By consent, the writ petition is taken up for final disposal.

The petitioner, on an earlier occasion had approached this Court by filing WP [MD] No.18197/2015, praying for issuance of writ of mandamus, directing the District Registrar, Thanjavur Registration District, to dispose of the appeal dated 13.06.2015 and this Court, vide order 08.10.2015, has disposed of the said writ petition by directing the respondent therein to dispose of the appeal dated 13.06.2015 within a period of eight weeks from the date of receipt of a copy of that order and in compliance of the order, the said authority has dismissed the appeal petition submitted by the petitioner, vide order dated 27.01.2016. Challenging the legality of the same, further appeal was filed before the Inspector General of Registration, the respondent herein, on 21.03.2016 by the Power of Attorney of the petitioner and since it has not been disposed of, the petitioner came forward to file the present writ petition.

Heard the submissions of the learned counsel for the petitioner and Mr.R.Govindasamy, learned Special Government Pleader who accepts notice on behalf of the respondents. This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the appeal petition submitted by the petitioner, directs the respondent to consider and dispose of the petitioner's appeal dated 21.03.2016 on merits and in accordance with law, after hearing the counter parties, viz., Tvl.K.S.Arulsamy and A.Arockia Rajasekar and pass orders within a period of ten weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to Tvl.K.S.Arulsamy and A.Arockia Rajasekar. The writ petition is disposed of with the above direction. No costs.
