Respondent Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari, calling for the entire records relating to the impugned order passed by the respondent in his Letter No.JE/O&M/Anumandhai/Ko.Audit/A183/14-15 dated 29.11.2014 and quash the same.

O R D E R

The order impugned dated 29.11.2014 is a demand made by the respondent based on the Audit Report. In respect of such demand made, the petitioner has to approach the Competent Authority or the Appellate Authority for adjudication of disputed facts. The High Court cannot conduct a roving enquiry in respect of such disputed facts in the writ proceedings as the impugned order merely states that based on the audit objection the demand is made and the petitioner is asked to pay the demand impugned within seven days. In the event of any objection or otherwise, the petitioner has to prefer an appeal or approach https://hcservices.ecourts.gov.in/hcservices/

the Consumer Grievances Redressal Forum for the purpose of adjudication of the issues to redress his grievances. Thus, the petitionr is at liberty to approach the Forum or the Appellate Authority for the purpose of adjudication of issues and redress his grievances. In the event of filing any such application, the Forum or the Appellate Authority shall consider the period during which the writ petition was pending before this Court for the purpose of condoning the delay, if any and decide the issues on merits and in accordance with law as expeditously as possible.

2. With the abovesaid liberty, the writ petition stands disposed of.However, there shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
