ORDER

Writ Petition is filed to call for the entire records which culminated in issuing the proceedings in Ka.No.E1/10631/Tha.Aapooka/Salem/2013 dated 30.04.2013 on the file of the respondent, quash the same and consequently to direct the respondent to appoint the petitioner in any suitable post befitting to his educational qualification on compassionate grounds within a time limit to be stipulated by this Court 2.The case of the petitioner is that his father, Mr.Venkateswaran, was employed as a Load Man with the respondent since 1987 and passed away on 28.06.1999. The petitioner's mother had predeceased his father, passing away on 16.05.1995. At the time of his father's death, the petitioner was only seven years old. He states that he studied up to the 11 th standard and later completed a Conductor Licence course. Upon attaining the age of majority, he submitted an 2/6

application dated 28.11.2011 seeking appointment on compassionate grounds. However, his application was rejected under the impugned proceedings dated 30.04.2013, on the ground of delay in submission. Aggrieved by the same, the petitioner has approached this Court.

3.Learned counsel for the respondent contended that the impugned order dated 30.04.2013 is legally valid and referred to G.O.Ms.No.120, Labour and Employment Department, dated 26.06.1995, which stipulates that applications for compassionate appointments must be submitted within a period of three years from the date of the government employee's demise. In the present case, since the petitioner submitted his application after a lapse of twelve years, he is not entitled to appointment on compassionate grounds. 4.Heard the learned counsel appearing for the parties. 5.There is no dispute regarding the date of death of the petitioner's father. The petitioner's primary contention is that he submitted the application after attaining the age of majority. However, the object of compassionate appointment is to provide immediate financial relief to the family of a deceased government employee. In this case, the petitioner and his family have managed their livelihood for over a decade. Therefore, even though the application was 3/6

submitted after the petitioner attended majority, the considerable delay of twelve years renders the claim untenable.

6.In view of the above, this Court finds no infirmity in the impugned order passed by the respondent. Accordingly, the writ petition is dismissed. No costs.
