The Joint Registrar / Special Officer v. The Joint Registrar Of Coop. Societies,
CMP No.15143 of 2024 in WA SR No.135799 of 2019 CMP No.15143 of 2024 in WA SR No.135799 of 2019 THE HON'BLE ACTING CHIEF JUSTICE and P.B.BALAJI, J.
This petition has been filed to condone the delay of 925 days in representing the writ appeal.
2. The petitioner has stated reasons in the accompanying affidavit to condone the above said delay. Apart from that, the learned counsel for the petitioner also filed a supporting affidavit, stating that the the writ appeal was filed on 30.10.2019 and it was returned on 04.11.2019 for want of some compliance. On receipt of the same, he handed over the papers to his clerk Mr.Gopal. During the Covid pandemic, his clerk died due to infection. Hence, he could not gather information as to the re-presentation of the case and also he could not trace out the papers from his office. After due diligence, now only he traced out the papers from the office and in such circumstances, there occurred a delay of 925 days in re-presenting the appeal. Hence, he prayed to condone the delay.
3. Being satisfied with the reasons assigned accompanying affidavit and also the supporting affidavit, we inclined to allow the petition, however, only on payment of costs.
