Criminal Original Petition filed under Section 438 of Cr.P.C., to enlarge the petitioner on bail in the event of his arrest in Connection with the Crime No.1498 of 2020 pending on the file of the respondent police.

ORDER
(This case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8 (C ) r/w. 20 (b) (ii)(b), 25 of NDPS Act in Crime No.1498 of 2020, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused was illegally found in possession of 2 Kgs of ganja. Hence, the complaint.
3. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case based on the confession of arrested accused. Hence, he prays for grant of Anticipatory Bail to the petitioner.
4. The learned Additional Public Prosecutor would submit that the petitioner along with other accused was illegally found in possession and transported 2 Kgs of Ganja. On seeing the police, he ran away from the scene of occurrence. He would further submit that the petitioner escaped with 1.700 Kgs of Ganja and there are no previous cases as against the petitioner. 5. Taking into consideration of the facts and circumstances of the case and also the fact that the petitioner is a druggist and he escaped from the scene of occurrence with 1.700 Kgs of Ganja, this Court is not inclined to grant Anticipatory Bail to the petitioner.
