A.No.688 of 2018 in C.S.No.64 of 2018 N.SATHISH KUMAR.J This application has been filed to permit the petitioner to deposit a sum of Rs.4,00,000/- to the credit of the above suit.

2. This application is filed to deposit a sum of Rs.4,00,000/- said to be the advance amount. The suit itself is filed for cancellation of the agreement.

3. It is the contention of the applicant that the agreement relates to an immovable property and this suit is filed for cancellation of the agreement and he has also offered to pay the amount. However, the same has been declined by the respondent. Hence, seeks permission of this Court to deposit the amount before this Court.

4. Having regard to the fact that the suit itself has been filed challenging the agreement and mere permission to deposit the amount into the Court will not cause prejudice any one and as counter has not been filed in this application, this application is liable to be allowed.

5. Accordingly, this application is ordered and the applicant is permitted to deposit the sum of Rs.4,00,000/- on or before 23.04.2018. On such deposit, the registry is directed to deposit the amount in interest bearing deposit in any of the nationalised Bank.
