Defendants Prayer : This Civil Suit has been filed under Section 56 of the Copyright Act read with Order IV Rule 1 of O.S.Rules read with Order VII Rule 1 of CPC praying for judgment and decree as follows:- a) to grant permanent injunction restraining the defendants in anyway granting Madurai and Ramanathapuram Districts Distributorship Rights, Satellite rights and Dubbing rights of the movie "Uyir Ezhuthu" to anyone else other than the plaintiff.

b) directing the defendants to pay the cost of the suit to the plaintiff.

c) grant such further or other reliefs.

For the Plaintiff : No appearance For the Defendants : No appearance

JUDGMENT

There is no representation for the plaintiff.

2. As seen from the notes papers, it is found that the matter was referred to the learned Additional Master - I for recording evidence, after issues were framed. It is found that the plaintiff is not interested to adduce evidence in support of his case. Subsequently, learned Additional Master -I has again referred the matter to the Court for further proceedings.

3. Even when the matter was listed before the Court on 21.04.2017, there was no representation for the plaintiff as well as the defendants. Accordingly, this Court directed the matter to be listed on 28.04.2017 under the caption "for dismissal". Even today also, there is no representation for the plaintiff as well as the defendants.

4. It is therefore evident that the plaintiff is not ready to prosecute the matter further.

5. Resultantly, the Civil Suit is dismissed for non-prosecution. No costs.
