ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) and 326 of BNS 2023, r/w 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No.43 of 2026 on the file of the respondent police seek anticipatory bail.

2. The case of the prosecution is that the petitioner was involved in illegal transportation of 12 units of pond mud in a lorry bearing Regn.No.TN-16U-2759 without any valid permit or licence and that the petitioner caught red handed by the respondent police. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and that he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted this Court has already granted anticipatory bail vide order dated 15.04.2026 in Crl.OP.No.9346 of 2026 to the petitioner with certain conditions. One of the conditions is that the petitioner was directed to make non-refundable deposit of

Rs.2,25,000/- directly to the credit of "Tamilnadu State Legal Service Authority, High Court Campus, Chennai" without prejudice to the right of the defence before the Trial Court and the receipt should be produced at the time of executing the bond. But, the petitioner did not comply the aforesaid conditional order imposed on him and to avoid the above payment, he filed the present application and tried his luck and that such conduct should be deprecated by dismissing this application. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent.

6. From the submissions of the learned Government Advocate (Crl.Side), this Court could able to see the ulterior motive of the petitioner to overreach the orders of this Court by suppressing the earlier bail order granted by this Court, which act is nothing but a suppression of fact and playing fraud against the Court. To put it differently, the petitioner has made the Court as his gambling ground, which conduct is really unfortunate. Therefore, this Court would like to record its displeasure against the conduct of the petitioner and his counsel.

7. Accordingly, this Criminal Original Petition is dismissed. 05-06-2026 VV
