ORDER
Seeking direction to the 2nd respondent to terminate the 28 weeks pregnancy of the petitioner's minor daughter, aged about 12 years through qualified doctors under the Medical termination of pregnancy (Amendment) Act, 2021, this writ petition is filed.
2.The learned counsel for the petitioner submitted that her 12 years old minor daughter is a victim, who was sexually assaulted, pursuant to which a criminal case in Crime No.10 of 2026 has been registered under Sections 87 of BNS and Sections 5(m), 5(l), 5(j)(ii) and 6 of the Protection of Children from Sexual Offences Act, 2012, as against the offenders. The minor child has been impregnated by the accused and she is currently 28 weeks pregnant and undergoing treatment in the 2nd respondent Hospital and sought indulgence of this Court to direct the 2nd respondent to terminate the pregnancy of her minor daughter.
3.The learned Government Advocate appearing for the respondents submitted that there is no impediment in carrying forward the termination of pregnancy of petitioner's daughter and submitted that a positive direction may be given in this regard.

4.In view of the above, the considered opinion of this Court is that pregnancy of the petitioner's minor daughter should be immediately terminated considering her health condition and well being. In view of the same, the 2nd respondent is directed to forthwith terminate the pregnancy of the petitioner's minor daughter on receipt of a web copy of this order. 5.In the result, this Writ Petition is disposed of with the above direction. No costs.
