Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the first respondent to dispose of the petitioner's representation dated 07.10.2020 seeking demarcation survey of the land comprised in Survey No.232/8K bearing patta No.8535, measuring about 21 cent situated at Siruvangoor Village Kallakurichi Taluk and District in accordance with Tamil Nadu Survey and Boundaries Act,1923 consequently directing the second respondent to give police protection at the time of survey.

O R D E R

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the first respondent to consider the representation made by the petitioner on 07.10.2020 wherein the petitioner has sought for survey of the subject property and demarcation of the same and for fixing the boundaries.

2. Mr.Mani Gopi, learned Government Advocate, appearing on behalf of the respondents submitted that the first respondent has already fixed a date for enquiry on 16.12.2020 at 10.30 A.M. The learned Government Advocate further submitted that the petitioner can be present at the time of enquiry along with all the relevant documents. https://hcservices.ecourts.gov.in/hcservices/

3. Taking into consideration the facts and circumstances

of the case and also of the fact that the first respondent has already called the petitioner for the enquiry, there shall be a direction to the first respondent to conduct an enquiry and take a decision in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

4. This writ petition is disposed of with the above directions. No costs.
