R.SURYA PRAKASH, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- Learned counsel for the petitioners submitted that the first accused is the brother of the deceased, the first petitioner is the sister of the deceased, the second petitioner is the sister-in-law of the deceased, the third and fourth petitioners are the parents of the deceased. A1 is the Eldest son to them and the deceased is another son.
2. The learned Government Advocate would submit that the case of prosecution is that due to family disputes with regard to the land disputes, one of the son of third and fourth petitioner, by using the grinding stone hit on the chest of the deceased and he sustained injury. Thereafter, the first accused was surrendered before the Police and gave statement. Initially, the case was registered under the Sections 294(b), 324, 506(ii) of IPC and subsequently modified as Section 307 of IPC, on the death of injured, it has been altered into Section 302 of IPC.
3. According to the learned Government Advocate, the investigation is at preliminary stage and the defacto complainant is none other than the daughter-in-law of the third and fourth petitioner. Inadvertently, she also state during the act of crime, these petitioners are available in the scene of occurrence and hence seeks for Anticipatory Bail.
4. Considering the nature and grievances of the offence which is at preliminary stage of investigation, I am not inclined to grant the Anticipatory Bail for the present.
