This writ petition is filed for a direction to the first and second respondents to issue refund of Rs.5,89,74,350/- along with interest under Section 244 A of the Income Tax Act, 1961 ('Áct') determined vide order under Section 143(1) dated 06.04.2021 in DIN CPC/2021/A3/152121059 for AY 2020-21.
When this matter is taken up today for hearing, the learned counsel for the respondents submitted that the relief sought for by the petitioner was granted and further submitted that the prayer of this writ petition was only to issue refund along with interest and rate of interest is not Page No.2 of 4
mentioned in the affidavit of this writ petition and against which the petitioner has also filed an application,which is still pending. In view of the above submission, this writ petition is dismissed as having become infructuous. No costs.
